1. Introduction and Scope
1.1 Purpose
This Acceptable Use Policy ("AUP" or "Policy") sets out the rules governing your use of the LEXX platform and related services (the "Service") provided by Lexx Software Co. Ltd., a company registered in Malta under registration number C 100540, with its registered office at Office 2, Room 2, Blue Angel, Triq Belvedere, Gzira, GZR 1112, Malta ("LEXX", "we", "us", "our").
This AUP is designed to:
- Protect the security, integrity, and availability of the Service for all users
- Prevent misuse that could harm other users, third parties, or LEXX
- Ensure compliance with applicable laws and regulations
- Maintain the reputation and trustworthiness of the LEXX platform
1.2 Relationship to Other Documents
This AUP is incorporated into and forms part of the Terms of Use. In the event of a conflict between this AUP and the Terms of Use, the Terms of Use prevail.
This AUP should be read together with:
1.3 Who This Applies To
This AUP applies to all persons and entities who access or use the Service, including:
- Registered users (free trial and paid subscribers)
- Account administrators and authorised users under business accounts
- Any person accessing the Service through your account or credentials
- API integrators who connect third-party tools to the Service
You are responsible for ensuring that all persons who access the Service through your account comply with this AUP.
1.4 Acceptance
By accessing or using the Service, you agree to comply with this AUP. If you do not agree with any part of this AUP, you must not use the Service.
2. General Principles of Acceptable Use
2.1 Lawful Use
You must use the Service only for lawful purposes and in accordance with:

- All applicable laws and regulations in your jurisdiction
- The terms and conditions of any cryptocurrency exchange you connect to through the Service (e.g., Binance, OKX)
2.2 Good Faith
You must use the Service in good faith and in a manner that does not adversely affect other users' ability to use and enjoy the Service.
2.3 Accurate Information
You must provide accurate, current, and complete information when creating your account and keep this information up to date. You must not impersonate another person or entity or misrepresent your affiliation with any person or entity.
2.4 Account Security
You are responsible for maintaining the security of your account, including:
- Using a strong, unique password
- Enabling two-factor authentication (2FA) where available
- Not sharing your login credentials with others
- Not sharing your exchange API keys with unauthorised parties
- Promptly notifying LEXX of any unauthorised access to your account at support@lexxsoft.com
3. Prohibited Uses
The following activities are prohibited when using the Service. This list is non-exhaustive; LEXX reserves the right to determine, in its reasonable discretion, whether any conduct violates the spirit of this AUP.
3.1 Illegal Activity
You must not use the Service to:
- (a) Engage in or facilitate any activity that violates any applicable law, regulation, or court order
- (b) Engage in or facilitate money laundering, terrorist financing, or the proceeds of crime
- (c) Evade or attempt to evade sanctions imposed by the European Union, United Nations, or any other applicable sanctions authority
- (d) Evade or attempt to evade tax obligations
- (e) Trade or attempt to trade in crypto-assets that are prohibited in your jurisdiction
3.2 Market Manipulation and Fraud
You must not use the Service to:
- (a) Engage in market manipulation, including wash trading, spoofing, layering, pump-and-dump schemes, or any other form of manipulative trading
- (b) Engage in fraudulent activity, including identity fraud, payment fraud, or misrepresentation
- (c) Place orders or execute trades with the intent to create a false or misleading impression of market activity
- (d) Coordinate with other users or third parties to artificially influence the price or volume of any crypto-asset
3.3 System Abuse and Security Violations
You must not:
- (a) Attempt to gain unauthorised access to the Service, other users' accounts, or any systems, networks, or data connected to the Service
- (b) Interfere with, disrupt, or attempt to disrupt the operation of the Service, including through denial-of-service attacks, malware, or other malicious code
- (c) Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except to the extent expressly permitted by applicable law (e.g., Directive 2009/24/EC on the legal protection of computer programs)
- (d) Circumvent, disable, or interfere with any security features of the Service, including authentication mechanisms, rate limiting, or access controls
- (e) Use automated tools (bots, scripts, scrapers) to access the Service in a manner that exceeds reasonable use or that is not authorised by LEXX
- (f) Probe, scan, or test the vulnerability of the Service or any system or network connected to the Service, unless you have LEXX's prior written consent (e.g., under a responsible disclosure program)
- (g) Exploit bugs, errors, or vulnerabilities in the Service for personal gain or to cause harm. If you discover a vulnerability, you must report it to security@lexxsoft.com
3.4 Content and Communication
You must not use the Service to:
- (a) Upload, transmit, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- (b) Send spam, unsolicited commercial communications, or chain letters through any communication features of the Service
- (c) Impersonate LEXX, LEXX employees, or other users
- (d) Distribute malware, viruses, or other harmful software through the Service
3.5 Account Misuse
You must not:
- (a) Create multiple accounts to circumvent enforcement actions, rate limits, or restrictions
- (b) Sell, transfer, or share your account or access credentials with third parties without LEXX's prior written consent
- (c) Use the Service on behalf of a sanctioned entity or person
- (d) Use a VPN, proxy, or other technology to disguise your location in order to circumvent geographic restrictions on the Service
3.6 Third-Party Rights
You must not use the Service to:
- (a) Infringe the intellectual property rights of LEXX or any third party
- (b) Violate the privacy or data protection rights of any person
- (c) Interfere with the lawful activities of other users of the Service
3.7 Exchange Terms Compliance
You must comply with the terms, conditions, and acceptable use policies of any cryptocurrency exchange you connect to through the Service (e.g., Binance Terms of Use, OKX Terms of Service). LEXX is not responsible for your compliance with exchange terms, and violations of exchange terms may also constitute violations of this AUP.
4. Enforcement
4.1 Graduated Response
LEXX enforces this AUP using a graduated approach, taking into account the nature, severity, and frequency of the violation:

LEXX reserves the right to apply any enforcement level appropriate to the severity of the violation, without being required to follow the levels sequentially.
4.2 Immediate Action
LEXX reserves the right to immediately suspend or terminate your account without prior warning for:
- Violations that pose an immediate risk to the security or integrity of the Service
- Violations involving illegal activity, fraud, or sanctions evasion
- Violations that may expose LEXX or its users to significant harm or liability
- Court orders or requests from law enforcement or regulatory authorities
4.3 Notice of Enforcement
Except in cases of immediate action under Section 4.2, LEXX aims to provide, to the extent practicable:
- Written notice (to your registered email address) of the violation and the enforcement action
- A description of the facts giving rise to the enforcement action
- Information about your right to appeal (see Section 4.5)
4.4 Effect of Termination
Upon account termination for AUP violations:
- Your access to the Service is revoked
- Your subscription is cancelled
- A refund may or may not be provided, depending on the nature of the violation and applicable law (see the Refund & Cancellation Policy)
- You may request export of your personal data in accordance with GDPR Article 20 and the Privacy Policy
- LEXX may retain records of the violation for legal and compliance purposes
4.5 Right to Appeal
You have the right to appeal any enforcement action by:
- Contacting legal@lexxsoft.com within 30 calendar days of receiving the enforcement notice
- Providing a written explanation of why you believe the enforcement action was unjustified or disproportionate
- LEXX aims to review your appeal and respond without undue delay
- Your appeal will be reviewed independently
If you are a consumer in the EU/EEA, your statutory rights under Directive 93/13/EEC (Unfair Contract Terms) and Directive 2011/83/EU (Consumer Rights) are preserved.
5. Reporting Violations
5.1 How to Report
If you become aware of any activity that violates this AUP, please report it to:

5.2 What to Include
When reporting a violation, please provide:
- A description of the suspected violation
- The date and time of the suspected violation (if known)
- Any evidence supporting the report (e.g., screenshots, transaction IDs)
- Your contact information (for follow-up, if needed)
5.3 Confidentiality
Reports are treated confidentially. LEXX does not disclose the identity of the reporter to the alleged violator, except where required by law or court order.
5.4 No Retaliation
LEXX does not retaliate against users who report violations in good faith. Good-faith reporting is protected even if the report ultimately proves to be unfounded.
This protection does not extend to reports that are knowingly false, vexatious, or submitted in bad faith.
6. Responsible Vulnerability Disclosure
6.1 Security Research
LEXX welcomes responsible security research. If you discover a vulnerability in the Service, we ask that you:
- Report the vulnerability to security@lexxsoft.com as soon as reasonably practicable
- Do not exploit the vulnerability beyond what is necessary to confirm its existence
- Do not access, modify, or delete other users' data
- Do not publicly disclose the vulnerability before LEXX has had a reasonable opportunity to address it (we aim to respond within a reasonable timeframe and prioritise remediation by severity)
6.2 Safe Harbour
LEXX does not generally intend to pursue legal action against security researchers who:
- Act in good faith and in compliance with this Section 6
- Do not cause harm to LEXX, the Service, or other users
- Report vulnerabilities in accordance with this Section 6
This safe harbour does not apply to activities that result in data exfiltration, service disruption, unauthorised access to customer data, or any action that compromises the security or availability of the platform.
7. Rate Limits and Fair Use
7.1 Fair Use
The Service is designed for individual or business use within normal parameters. LEXX reserves the right to impose rate limits on API usage, trading operations, and other Service features to ensure fair access for all users and to maintain platform stability.
7.2 Rate Limit Notification
If your usage approaches or exceeds a rate limit, LEXX may, at its discretion:
- Provide reasonable notice where practicable
- Explain the applicable limit and the reason for its imposition
- Offer guidance on adjusting usage to comply with limits
7.3 Excessive Use
Consistently excessive use that degrades the Service for other users may be treated as a violation of this AUP and subject to enforcement actions under Section 4.
8. Changes to This Policy
LEXX may update this AUP from time to time. We will notify you of material changes by:
- Email notification to your registered email address at least 14 calendar days before the changes take effect
- A notice on our website
Continued use of the Service after the effective date of any changes constitutes acceptance of the amended AUP. Where you are a Consumer within the meaning of Directive 2011/83/EU, your express consent will be obtained for any material changes. If you disagree with any changes, you may cancel your subscription in accordance with the Refund & Cancellation Policy.
